Welcome to our community at Guaranteed Health, Inc.    

Let’s talk about some terms we use in the Policy.  Guaranteed Health, Inc. may be referred to as "Guaranteed," “we,” “our,” or “us.”  We call a user of the Guaranteed Platforms “User,” “Users,” “you,” or “your” as appropriate.  

The community platforms that we offer at our websites and all related subdomains are referred to as the “Sites.”  These are as follows:

In the future, when mobile applications are available, the mobile applications you will use to access the platforms (whether on iOS or Android) are referred to as the “Apps.” The Sites and Apps are referred to collectively as the “Platforms”. 

The features of the Platforms, including the interactive areas, are called the” Services”. 

This Privacy Policy covers how Guaranteed collects, receives, uses, retains, and discloses Personally Identifiable Information (“PII”) and Protected Health Information (”PHI”) via the Services. PII includes information about you that is personally identifying such as your name, email address, and phone number and which is not otherwise publicly available.  PHI includes information relating to your health, for example medical history, health conditions, test and laboratory results, physician referrals, insurance information and other data that a healthcare professional may collect to identify an individual and determine appropriate care.  PII and PHI may include other types of information depending on the legal definition that applies in your physical location. Only the definitions of PII and PHI that apply in your location will apply to you under this Privacy Policy. PII and PHI are referred to collectively in this Privacy Policy as “Personal Information.” 

If you voluntarily provide your information in the course of interacting with our Platforms or otherwise using our Services, we will take that as your agreement to our collection, use, and disclosure of your information as set forth in this Privacy Policy. 

When you visit our Platforms, you entrust us with your Personal Information. We take that trust very seriously. In this privacy notice, we describe our privacy practices. We will explain to you in the clearest way possible what information we collect, why we collect it, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. 

This Privacy Policy does not apply to any products, services, websites, or content that are offered by third parties (“Third Party Services”), which are governed by their respective privacy policies.

1.              Types of Personal Information We Collect

Information You Give Us.
  You do not need to register for an account or give us any information just to visit our Sites.  However, if you wish to obtain more information or register as a patient, you will need to give us information by registering for an account, entering information through our online forms, contacting us through Platforms, purchasing or ordering services, or contacting us by phone or email for information or customer service.

               ● Audio, electronic, visual, or similar information, such as access to the camera on your mobile device, to participate in telemedicine                         calls with participating providers.

              ● Professional, employment, or education information, such as copies of your resume or CV and any other information required to                         verify your qualifications, for recruitment purposes. 

Information About You from Third Parties 
We may also receive information about you if you are a patient from family members of potential patients, referring providers (clinicians, administrators, support staff,), insurance providers and providers of other services to you. 

Information We Automatically Collect.
Like many website operators, we collect information that your browser sends whenever you visit our Sites. This includes Log Data, such as your device’s IP address, browser type, browser version, the pages of our Sites that you visit, the time and date of your visit, the time spent on those pages and other statistics, and whether you reached our page via a social media or email campaign. This information may be collected via several technologies, including cookies, web beacons, clear GIFs, canvas fingerprinting and other means, such as Google Remarketing and Facebook Pixel. You can control cookies in your browser to enable or disable them. Information We Collect from Third Parties.
If you access our Platforms through third parties (e.g., Instagram or Twitter or Google), or if you share content from our Platforms to a third-party social media service, the third-party service will send us certain information about you if the third-party service and your account settings allow such sharing. The information we receive will depend on the policies and your account settings with the third-party service. We may also collect information from joint marketing partners and service providers.

Inferences.  
Using the other pieces of personal information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.

We use your personal information for various purposes as follows:

                          ● On Demand Video Telemedicine with Medical Providers
                          ● On Demand Web, Mobile, and Cell-based Chat with Medical Providers
                          ● Medical Billing Management
              ● To provide you with durable medical equipment
              ● To track your medical supply order
              ● To process your transactions with our payment providers or platforms
              ● To market our services to you
              ● To provide any requested location-based services
              ● With respect to website cookies, to share with third-party marketing partners to provide tailored advertising on our Platforms and                         other websites that you may visit
              ● To analyze Platforms usage and improve the services offered
              ● For requesting feedback, market research, project planning, troubleshooting problems
              ● To provide you with employment opportunities if you apply for a job with us. 
              ● For detecting and protecting against error, fraud or other criminal activity and respond to legal requests

3.   Personal Health InformationAny PHI is collected via HIPAA compliant platforms.   These include website analytics platforms (such as Freshpaint), user-entered data (such as a medical intake forms), and company-entered user data (such as Medical Record updates). All PHI data is stored, via third party cloud providers and third party EMR web application providers.  Any third parties involved in collecting, storing, transferring, and/or deleting patient data maintain appropriate Business Associate Agreements with Guaranteed.

              When We Share Personal Information
We may share or disclose Personal Information as follows:

Medical Professionals and Medical Service Providers. 
In order to provide patient care, we may share your information with health care providers: (i) to schedule and fulfill appointments and provide health care services as part of the Services, (ii) to whom you send messages through our Services, and (iii) for other treatment, payment or health care operations purposes, including pharmacy, laboratory, radiology or other ancillary services, upon your request. These third parties are contractually obligated to maintain the confidentiality of your Personal Information consistent with the terms of this Privacy Policy and to comply with the applicable data protection laws

Affiliates and Service Providers. We share your information with our affiliates and with third-party service providers and any subcontractors as required to offer you our products and services.  We may add or change service providers from time to time.  All our affiliates and service providers agree to comply with the privacy practices set out in this Policy.  As of the date of this Privacy Policy, a list of our service providers with whom we share information is below:

● Website Builders / Web Hosting: WebFlow, Strikingly, Sanity
● DNS Management: Google Domains
● Emails (Transactional, Marketing): SendGrid, WebFlow
● Payment processors: Stripe

Third Party Marketing and Advertising Organizations.
With respect to website cookies, we share your information with third party marketing and advertising partners to market our services on our Platforms and other websites that you may visit. Learn more in Cookies and Other Tracking Technologies.Third Party Links and Websites. Our Platforms may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept liability for these policies. Please check these policies before you submit any data to these websites. In specific circumstances in our Apps, we may display third-party hosted advertisements. We may share a unique identifier with the third-party advertiser in order to offer you virtual currency, gifts, or other items for engaging with the advertisement offer. We are not responsible for any interactions with the third-party advertiser after you have left our Platforms.

Disclosures Required by Law.
We may be required to disclose your data in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share your personal information in order to comply with any legal obligation, to enforce or apply our terms and conditions and other agreements, to protect our rights, property, or safety, or to protect the rights, property, or safety of others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

Business Transfers.  
We reserve the right to disclose and transfer your Personal Information: (i) to a subsequent owner, co-owner or operator of the Platform and/or our Services; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including during any due diligence process.  
On the Basis of Consent.  
Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your Guaranteed account or participating in promotional activities by Guaranteed partners or third parties.

For Internal Business Processes and Promotion.    
Where permissible under applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms, to drive traffic to Guaranteed’ Platforms, or otherwise promote our products and services.
Automated individual decision-making, including profilingWe do not engage in automated individual decision-making or profiling. 

5.              How We Respond to ‘Do Not Track’ SignalsDo Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We do not recognize or respond to browser-initiated DNT signals, as the Internet industry is currently still working toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT.

6.              Cookies and other Tracking Technologies
To make our Platform work properly, we sometimes place small data files called cookies on your device. A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, shopping cart, or other preferences) over a period of time, so you do not have to keep re-entering them whenever you come back to the site or browse from one page to another.  We may also use web beacons, embedded scripts, etags, browser fingerprinting and other recognition technologies to improve your user experience. 

Google Analytics.
We use Google Analytics. We use the information we get from Google Analytics only to improve this site. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Please refer to Google’s Privacy Policy for more information. You may also choose to download the Google Analytics opt-out browser add-on

Google Ads/Facebook Pixel.
We may now or in the future also use Google Ads and Facebook Pixel to deliver tailored advertising on our Platforms and other websites that you may visit. You can learn more about how to control advertising cookies by visiting the Network Advertising Initiative’s Consumer Opt-Out link, the DAA’s Consumer Opt-Out link for browsers, or the DAA’s opt-out link for mobile devices. Please note that electing to opt-out will not stop advertising from appearing in your browser or applications and may make the ads you see less relevant to your interests.

7.  Integrating Social Networking Services
 
One of our special features allows you to access the Services via various social networking services like Tik-Tok, Instagram, Google, or Twitter  (“Social Networking Service(s)”). By directly integrating these services, we make your online experiences richer and more personalized. To take advantage of this feature, we will ask you to log into or grant us permission via the relevant Social Networking Service. When you add a Social Networking Services account to the Services or log into the Services using your Social Networking Services account, we will collect relevant information necessary to enable the Service to access that Social Networking Service and your data contained within that Social Networking Service. As part of such integration, the Social Networking Service will provide us with access to certain information that you have provided to the Social Networking Service, and we will use, store and disclose such information in accordance with this Privacy Policy.You may also have the option of posting your activities to Social Networking Services when you access content through the Platform; you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity. Because we use social media plugins, if you visit our Platform while logged in to a social networking account, personally identifiable information about your browsing activities on this Platform may be transferred to the third party who operates that account. See the third party’s terms of service and privacy policy for more information on what information may be transferred and what you can do to avoid or limit the transfer of information.  

8.              Your Privacy Choices
You have choices about how we use your Personal Information and have rights to instruct us how to use it, subject to certain exceptions.  Please contact us at the addresses set forth below if you would like to request access and/or make any changes to your personal information. 

Marketing Opt Out:
We may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe instructions provided in any email we send, or you can contact us using the contact details provided in the “Contact Information” section below. You will still continue to receive service-related messages concerning products and services you have purchased (unless we have indicated otherwise) until you cancel your registration.

Push Notification Opt Out:
We may send you notifications to your device. You can configure your device settings to turn off these notifications. 

Exercising Your Privacy Rights.
We have listed the privacy rights for several jurisdictions in separate sections at the end of this Policy, but we understand you may have additional rights in your jurisdiction. You may contact us directly at any time about exercising your data protection rights. We will consider your request in accordance with applicable laws.

9.              International Transfers of Data
Any data that you provide to us may be accessed, shared or processed by our offices, located in the United States, and service providers located in the United States, if such data transfer is necessary for the specific purpose for which you submitted your data (such as the provision of goods or services under a written contract). This may entail a transfer of your personal information across international borders. The data protections standards may differ and be lower than the standards enforced in your jurisdiction.We maintain appropriate safeguards as required by applicable law for any personal information transferred internationally, and as required by applicable law, will seek your consent prior to such transfers or rely on applicable law for other authorization.

10.           Children’s Privacy
The Platforms are not directed at individuals under the age of 13, although we may provide services to children under the age of 13 only with the knowledge and consent of their parent or guardian. We do not knowingly collect personal information from children under 13 without verifiable parental or guardian consent or as permitted by law. If you become aware that a child has provided us with personal information without their consent or the verifiable consent of their parent or guardian, please contact us using the contact details provided in the “Contact Information” section below, and we will take steps to delete such information.
11.           Security 
We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. For example, when possible, we use encryption to transfer and store data. We further limit access to this data using access controls and confidentiality commitments. However, no website, application, or transmission can guarantee security. Thus, while we have established and maintain what we believe to be reasonable procedures to protect the confidentiality, security, and integrity of personal information obtained through the Platforms, we cannot ensure or warrant the security of any information you transmit to us.

12Data Retention 
We retain information from or about you for so long as necessary to fulfill the purposes outlined in this Privacy Policy. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrolment with our products or services, the impact on the services we provide to you if we delete some information from or about you, mandatory retention periods provided by law and the statute of limitations. We encourage you to refer to the specific platform’s privacy policy in connection with your purchase.

You have the right to request the deletion of any personal data we have collected from you, in accordance with applicable privacy laws. If you wish to have your data deleted, please contact us at [email protected] receiving your request, we will take reasonable steps to verify your identity and will process your request in compliance with applicable legal requirements. Please note that certain data may be exempt from deletion under specific circumstances, such as when it is necessary for compliance with legal obligations, the establishment or defense of legal claims, or if it is integral to the performance of services you have requested.Once your request is verified, we will delete your personal data from our systems within 30 days. We will also notify any third-party service providers or partners with whom we have shared your data of your deletion request, to the extent required by law.

GDPR Privacy Rights
If you are a resident of or located within the EU or European Economic Area (“EEA”), you have certain additional data protection rights under the General Data Protection Regulation (“GDPR”). These rights include:
                 ● The right to access, update or delete the information we have on you.
                 ● The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
                 ● The right to object. You have the right to object to our processing of your Personal Information.
                 ● The right of restriction. You have the right to request that we restrict the processing of your personal information.
                 ● The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-                           readable and commonly used format.
                 ● The right to withdraw consent. You also have the right to withdraw your consent at any time where we relied on your consent to                           process your personal information.

Legal Basis for Processing Personal Information under GDPR
Guaranteed’s legal basis for collecting and using the Personal Information described in this Privacy Policy depends on the Personal Information we collect and the specific context in which we collect it.Guaranteed may process your Personal Information because:  
               ● We need to perform a contract with you;  
               ● You have given us permission to do so;
               ● The processing is in our legitimate interests, and it is not overridden by your rights; or
               ● To comply with the law.

Disclosure of Personal Information under GDPR-Legal Requirements 
Guaranteed may disclose your Personal Information in the good faith belief that such action is necessary to:  
               ● To comply with a legal obligation;  
               ● To protect and defend the rights or property of Guaranteed;  
               ● To prevent or investigate possible wrongdoing in connection with the Service;  
               ● To protect the personal safety of users of the Service or the public; or
               ● To protect against legal liability.

Disclosure for Law Enforcement Under certain circumstances, Guaranteed may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).If you are a resident of the EU or EEA, you may initiate a request to access, reject, correct, restrict, or erase your Personal Information, or where you may initiate a request for transfer of your Personal Information or initiate a request that we refrain from sending you marketing information by sending us a request at [email protected] and write “GDPR Request” in the subject line.  Please note that the above individual rights are not absolute, and we may be entitled to refuse requests where certain exceptions apply.  Please note that where our processing of your Personal Information relies on your consent and where you then withdraw that consent, we may not be able to provide all or some aspects of our services to you and/or it may affect the provision of those services. Should you wish to raise a concern about our use of information (without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority.

Your California Privacy Rights
This section applies solely to California residents. We adopt this Policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”). Any terms defined in the CCPA or CPRA have the same meaning when used in this Section.California residents have the following rights:

              a.     Request for Information, Correction, or Deletion
California consumers have the right to request, under certain circumstances, that a business that collects personal information about the consumer disclose to the consumer the information listed below for the preceding 12 months:

             ● The categories of sources from which the personal information is collected; 
             ● The business or commercial purpose for collecting, selling or sharing personal information;
             ● The categories of third parties to whom the business discloses personal information; and
             ●  The specific pieces of personal information collected about you.

Please note that if we collected information about you for a single one-time transaction and do not keep that information in the ordinary course of business, that information will not be retained for purposes of a request under this section. In addition, if we have de-identified or anonymized data about you, we are not required to re-identify or otherwise link your identity to that data if it is not otherwise maintained that way in our records.

You can also request that we correct or delete your personal information. There may be certain exceptions to our obligation to delete your information such as if you have an existing account or transaction with us or if we have a legitimate business reason to keep your information.  In compliance with California law, Guaranteed provides the following information about our collection of certain types of personal information about you during your relationship with us, as stated above.                 b.     Do Not Sell My Personal Information
As a California resident, you also have the right, at any time, to tell us not to sell personal information – this is called the “right to opt-out” of the sale of personal information. At this time, we do not sell our consumers’ personal information to third parties.
